The usage of nitrogen, according to critics, might hurt everyone in the room unnecessarily and result in a leak.

Smith, then fifty-eight, was found guilty in 1989 of killing Elizabeth Sennett.

The prisoner’s attorneys informed the BBC on Wednesday night that they were submitting a new appeal to the country’s highest court in the hopes of obtaining a last-minute reprieve. The offender has been on death row since 1996.

Pure nitrogen breathed without oxygen causes the cells to degrade and eventually die. Alabama stated in a court document that they anticipate his death in a few minutes and his loss of consciousness in a few seconds.

However, some medical experts have opposed its usage, stating that it might result in a number of disastrous events, such as severe convulsions or lasting in a vegetative state.

Smith was found guilty along with another man of killing Sennett, 45, in March 1988 as part of a $1,000 (£790) killing-for-hire.

She was stabbed in the neck and chest, battered with a fireplace tool, and had her murder staged to resemble a break-in and burglary.

The plan to gather insurance money was masterminded by her husband, pastor Charles Sennett, who was deeply in debt. With the detectives closing in, he committed suicide.

In 2010, John Forrest Parker, Smith’s fellow hitman, was put to death.

Smith stated he did not participate in the attack during his trial, although he did acknowledge being there when the victim was slain.

The UN High Commissioner for Human Rights has demanded an end to Smith’s gassing, stating that it may constitute torture or other cruel, inhuman, or degrading treatment.

Smith’s attorneys filed a case with the Supreme Court, claiming that trying to execute convicted individuals more than once is against the US Constitution’s Eighth Amendment, which forbids “cruel and unusual” punishment.

The court turned down his appeal and turned down his request to put an end to the execution on Wednesday. No justice voiced opposition with the decision in public.

Smith also disputed the validity of Alabama’s nitrogen gas protocol in a different legal appeal to the lower 11th US Circuit Court of Appeals.

However, in a decision on Wednesday night, that court also denied the prisoner’s plea for an injunction.

Attorneys for Smith declared they will file an appeal with the Supreme Court once more.
